By commissioning Kilisuci Artlabs, you agree to the following terms and conditions

1. General
Acceptance of Terms
By commissioning or using any services provided by Kilisuci Artlabs, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not proceed with a commission.
Service Scope
Kilisuci Artlabs provides custom digital art services, including but not limited to VTuber models, character illustrations, PNGtuber assets, and related creative services. Specific deliverables depend on the agreed commission details.
2. Eligibility
Age Requirement
You must be at least 18 years old to commission services, or have permission from a parent or legal guardian.
3. Commission Process
Request & Approval
All commissions begin with a submitted request form. Work will only start after the scope, pricing, and deliverables are agreed upon by both parties.
Communication
All official communication will be conducted through the agreed channels. Clients are responsible for providing clear and complete references to avoid delays.
4. Payment
Payment Terms
Full or partial payment may be required before work begins, depending on the commission type. Payment methods and schedules will be communicated during the agreement stage.
Non-Refundable Work
Once work has begun, payments are generally non-refundable due to the custom nature of the service, unless otherwise stated.
4. Revisions
Revision Policy
Revisions are included as specified per commission type. Excessive or out-of-scope revisions may incur additional fees.
General revision (apply to Vtuber, PNGtuber, Character Sheet, Emote, and Background)
You are limited to 3 edit sessions during sketching stage, and 1 chance for minor adjustments in the finishing stages (including hues, painting in missing details, etc.)
Any further edits will have added fees to the overall cost, especially past the polished or line art stage. We will inform you beforehand of the cost based on the approximate time and effort for each adjustment.
Client Responsibility
Clients are expected to review work carefully at each revision stage. Approval of a stage confirms acceptance and progression to the next phase.
5. Timeline
Turnaround Time
Estimated turnaround times are provided as guidance and may vary depending on project complexity, revision requests, and workload.
Delays
Kilisuci Artlabs is not responsible for delays caused by late responses, missing information, or changes in scope requested by the client.
5. Delivery
Final Files
Final deliverables will be provided in the agreed digital formats. It is the client’s responsibility to download and back up files upon delivery.
Kilisuci Artlabs is not responsible with files within 90 days after delivery time past
6. Usage Rights
Personal & Commercial Use
Unless otherwise agreed, commissioned works include rights for personal and commercial use by the client. Resale or redistribution of the original files is not permitted.
Artist Rights
Kilisuci Artlabs retains the right to display completed works in portfolios, social media, and promotional materials unless a prior agreement is made.
7. Intellectual Property
Client-Provided Materials
Clients may provide references, concepts, or materials as part of a commission request. By submitting these materials, the client confirms that they own the rights or have permission to use them.
Copyright Responsibility
Kilisuci Artlabs is not responsible for verifying the copyright status of client-provided materials. The client assumes full responsibility for ensuring that any provided content does not infringe on third-party intellectual property rights.
Liability Release
The client agrees to release and hold harmless Kilisuci Artlabs and its artists from any claims, damages, or legal actions arising from the use of copyrighted, trademarked, or otherwise protected materials supplied by the client.
Infringing Requests
Kilisuci Artlabs reserves the right to refuse or terminate any commission that involves content believed to be infringing, unlawful, or in violation of intellectual property rights.
Derivative Works
If a commission is based on existing characters, brands, or intellectual properties, the client acknowledges that the resulting artwork may be considered derivative and accepts all associated legal risks.
Indemnification
The client agrees to indemnify and defend Kilisuci Artlabs against any claims, losses, or expenses resulting from intellectual property disputes related to client-provided materials.
8. Cancellations
Client Cancellation
Clients may request cancellation before work begins. Once work has started, cancellation may result in partial or no refund.
Artist Cancellation
Kilisuci Artlabs reserves the right to cancel a commission due to abusive behavior, lack of communication, or violation of these terms.
9. Modifications
Terms Updates
These Terms of Service may be updated at any time. Continued use of services constitutes acceptance of the revised terms.
